Defending Domestic Violence Accusations

A domestic violence accusation can change a person’s life before the case ever reaches trial. An arrest, criminal charges, or a no-contact order can separate someone from home and family, interfere with employment, and threaten important rights. These cases deserve careful investigation, sound legal judgment, and a criminal defense lawyer prepared to challenge the prosecution’s evidence.

At Dalton Law Office, PLLC, we represent people accused of misdemeanor and felony domestic violence offenses throughout Southwest Washington. Attorney Nicole T. Dalton brings 20 years of litigation experience to the defense of clients facing serious criminal allegations.

What Constitutes Domestic Violence Under Washington Law?

In Washington, domestic violence is not limited to physical assault between spouses or romantic partners. A criminal charge may carry a domestic violence designation because of the relationship between the people involved. Depending on the circumstances, that relationship may involve current or former spouses, dating partners, people who share a child, family members, or people who live or have lived together.

Domestic violence cases may involve felony or misdemeanor assault, harassment, stalking, malicious mischief, burglary, unlawful imprisonment, kidnapping, violations of no-contact or protection orders, and sexual offenses. Even disputes involving shared or jointly owned property can raise complicated criminal questions when allegations of property damage arise.

The nature of the relationship, the particular offense charged, and the evidence supporting each required element matter. A domestic violence designation does not relieve the prosecution of its obligation to prove the criminal charge.

Arrests, No-Contact Orders, and Serious Consequences

An argument or confrontation can result in an arrest even when neither person anticipated that the police would become involved. Washington law requires officers to make arrests in certain domestic violence situations when the applicable statutory conditions are met.

Criminal no-contact orders can create immediate and sometimes devastating practical consequences. A person may be prohibited from returning home, communicating with a spouse or partner, or having ordinary contact with family members. These orders must be obeyed unless and until the court changes them, even if the protected person initiates contact or wants the restrictions lifted.

The wishes of the person identified as the victim do not necessarily determine whether the prosecution will continue. Once criminal charges are filed, the prosecuting authority generally controls whether to pursue or dismiss the case.

Depending on the charges and circumstances, a conviction may carry incarceration, financial penalties, firearm restrictions, employment or professional licensing consequences, and complications involving parenting and family relationships. Some consequences can arise from court orders even before a conviction.

The Evidence Matters. So Does the Entire Story.

Domestic violence cases often arise in emotionally charged circumstances. Sometimes allegations are supported by substantial evidence of serious misconduct. In other cases, the accounts are incomplete, witnesses disagree, statements are misunderstood, or accusations are exaggerated or false. The existence of an accusation does not establish what actually happened.

A police report is a starting point, not a verdict.

Effective criminal defense requires looking beyond the initial allegations. That may mean examining body-camera recordings, 911 calls, photographs, medical evidence, text messages, communications between the parties, witness accounts, physical evidence, and the circumstances surrounding an arrest. Questions of credibility, intent, self-defense, and the reliability of the State’s evidence may be central to the case.

Our firm works with professional investigators when appropriate and uses pretrial motions, evidentiary challenges, negotiations, and trial advocacy to protect our clients’ rights and pursue defensible results.

My experience with Nicole Dalton and her staff saved my life. Literally. I was wrongfully arrested while in an abusive relationship and her staff worked day and night to not only support me emotionally but they believed me, they kept me strong when I wanted to break and they got all my charges dropped.
